Subject: Request for Suo Motu Cognizance of Repeated Examination Paper Leaks as a Human Rights Issue Affecting India's Youth
Respected Hon'ble Chairperson,
I write to you in my capacity as the Founder of the People's Vigilance Committee on Human Rights (PVCHR) and a former Member of the NGO Core Committee of the National Human Rights Commission (NHRC). Having worked closely with the Commission's mandate of promoting and protecting human rights, I am deeply concerned by the recurring examination paper leaks that have severely impacted millions of students and job aspirants across India.
This issue transcends politics. It is fundamentally about the human rights, dignity, equality, and future of India's youth. Over the past decade, repeated paper leaks across recruitment and educational examinations have led to cancellations, retests, prolonged delays, financial burdens, and immense psychological distress. Honest candidates, many from marginalized and economically weaker backgrounds, have become victims of systemic failures over which they have no control.
These recurring incidents raise serious human rights concerns:
- Violation of Article 14 (Right to Equality): Paper leaks undermine equal opportunity by conferring unfair advantage upon those involved in malpractice.
- Violation of Article 21 (Right to Life and Personal Liberty): The prolonged uncertainty, anxiety, depression, and loss of livelihood opportunities resulting from repeated examination failures adversely affect the dignity and mental well-being of students.
- Violation of the Right to Education and Fair Access to Public Employment: The integrity of examinations is central to ensuring equal opportunity and public confidence in democratic institutions.
The repeated nature of these incidents points not merely to isolated criminal acts but to systemic governance failures requiring institutional intervention.
In view of the above, I respectfully urge the National Human Rights Commission to:
- Take suo motu cognizance of the recurring examination paper leak incidents across India.
- Call for reports from the Union Government, State Governments, examination authorities, and investigating agencies regarding preventive and corrective measures.
- Conduct an independent inquiry into whether repeated paper leaks constitute violations of the human rights of students and job aspirants.
- Recommend comprehensive reforms to strengthen examination security, transparency, accountability, and technological safeguards.
- Recommend measures for psychological support, timely completion of examinations, and appropriate relief for candidates adversely affected by cancellations and delays.
- Issue policy recommendations to ensure that the rights and dignity of students are protected and that public confidence in recruitment and educational examinations is restored.
The future of India's youth depends upon a fair, transparent, and credible examination system. The NHRC, as the country's premier human rights institution, has a vital role in addressing this systemic issue through its constitutional and statutory mandate.
I sincerely hope that the Commission will consider this matter with the urgency it deserves and initiate appropriate proceedings in the larger public interest.
